Terms of Service

Welcome to Bantsy. These Terms are an agreement between you and 17148178 Canada Inc., based in Quebec, Canada, which operates Bantsy (“Bantsy”, “we”). They apply to the Bantsy website and apps. By creating an account, you agree to them and to our Privacy Policy.

1. Who can use Bantsy

  • You must be at least 18 to use Bantsy, for every feature.
  • Keep your account secure and your details accurate. One account per person.
  • Don't use Bantsy if the law prohibits you from doing so, for example because of sanctions.

2. What Bantsy is

Bantsy is an open platform for short voice notes, five minutes or less.

  • Anyone eligible can listen, follow, start a channel and publish, without approval from us.
  • Creators publish Solo voice notes on their own.
  • Two people can create a Bantsy Together conversation (section 5).
  • Every voice note is automatically transcribed, so listeners can read along and voice notes can be found in search. Creators can review and correct their transcripts before publishing.

Creators are responsible for what they publish. We don't review content before it goes live, and it doesn't represent our views. Transcripts are created automatically and may contain errors.

3. Your content

It's yours. You own your voice notes and everything else you publish on Bantsy.

What you allow us to do. So that Bantsy can work, you give us a worldwide, non-exclusive, royalty-free licence to:

  • store, process and make technical adjustments to your content (for example, formats and volume)
  • create a transcript of each voice note, and show it with the voice note to the same audience
  • show and play your content to the audience you choose
  • feature and recommend your public voice notes within Bantsy, for example in discovery feeds, search and recommendations
  • let people share links to your public voice notes

The licence ends when you delete the content. We may keep copies only as our Privacy Policy explains.

Ads and marketing need your permission. We won't use your voice or your content in advertising, paid promotions or Bantsy brand campaigns outside Bantsy without asking you first.

Your responsibilities. Publish only content you have the rights to. Make sure everyone whose voice can be heard has agreed to being recorded and published. Transcript editing is for correcting transcription errors, not for changing the meaning of what was said. We keep the original automatic transcript privately, as our Privacy Policy explains.

4. Content rules

Keep Bantsy a place people want to be. Don't post or use Bantsy for:

  • anything illegal, or that infringes someone else's rights, including music you don't have rights to
  • harassment, threats, hate, or incitement to violence
  • sexual content involving minors, in any form; sexually explicit content; or intimate content shared without consent
  • recording someone, or sharing their private information, without their consent
  • impersonation, scams, spam or misleading content
  • getting around paywalls, scraping Bantsy, faking plays or follows, or interfering with the service

You can report content and block other users at any time.

5. Bantsy Together

Bantsy Together lets two people create one conversation. These rules protect both of you.

1. Exactly two people. An invitation is only a request. Nobody has to accept it.

2. Both consent. Each person agrees to take part before recording.

3. Both approve the exact final version before it's published: the audio, the transcript as it will be shown, with each person's words labelled, the title, description, cover, who can listen, and which channel it's published on.

4. Any change means approving again. If anything changes after approval, including the transcript, both people must approve the new version.

5. Either person can make it unavailable, immediately, at any time after it's published. No permission from the other person is needed. Both of you are notified.

6. Making it available again requires both people's approval.

7. Permanent deletion. A conversation made unavailable, with its transcript, is kept for 90 days so we can handle disputes and safety reviews. Then it's permanently deleted, unless a dispute is open or the law requires us to keep it.

Each person owns their own voice segments. Each lets the other and Bantsy publish them only in the version both approved. Each person can correct only the transcript of their own words, and both approve the final corrected transcript. Any earnings go to the owner of the channel where the conversation is published.

6. Subscriptions

Creators are the sellers. When you subscribe to a channel, you're buying from that creator. Bantsy provides the platform and processes the payment on the creator's behalf through Stripe. The creator sets the price, within the limits we allow.

Before you subscribe, we show you:

  • the price, currency and any taxes
  • how often you'll be billed
  • how to cancel

Renewal and cancelling. Subscriptions renew automatically until you cancel.

  • You can cancel anytime in your settings.
  • After you cancel, you keep access until the end of the period you've already paid for, and you won't be charged again.
  • We remind you before an annual subscription renews.
  • If the price changes, we tell you before it applies, and you can cancel first.

Refunds.

  • Payments generally aren't refundable for partial periods. Creators may choose to give refunds.
  • We'll refund you for billing errors, duplicate charges and unauthorized payments, and whenever the law requires it.
  • If a channel permanently closes or is removed, we'll refund the unused part of your current paid period where appropriate.
  • Nothing in these Terms takes away rights consumer laws give you.

What a subscription includes. Access to that channel's subscriber-only voice notes while your subscription is active. It doesn't guarantee how often new voice notes are published.

App stores. If you buy through the App Store or Google Play, their payment and refund rules apply to that purchase.

7. Getting paid as a creator

  • To sell subscriptions, you connect your own Stripe account and accept Stripe's terms. Paid subscriptions are available only in countries where Stripe and Bantsy support them, starting with Canada and the United States.
  • Bantsy keeps a platform fee of 10% of each subscription payment. You pay Stripe's processing fees. Stripe pays out the rest to you on its schedule.
  • As the seller, you're responsible for your subscribers' refunds and chargebacks, your own income taxes, and any sales taxes you owe. Where the law makes the platform responsible for collecting sales tax, we collect it and pay it to the authorities.
  • We may pause paid features or payouts while we investigate fraud or a serious breach of these Terms.

8. Removing content and leaving

  • You can delete your voice notes, or your account, at any time. A voice note's transcript is deleted with it. Together conversations follow section 5.
  • Copies other people already made outside Bantsy are beyond our control.
  • We may remove content or restrict, suspend or close accounts that break these Terms or the law. Unless it's unsafe or illegal to do so, we'll tell you what we did and why. You can ask us to reconsider at hey@heybantsy.com.
  • Copyright complaints: send them to hey@heybantsy.com. We remove infringing content and close the accounts of repeat infringers.

9. Our responsibility

  • We work hard to keep Bantsy running well, but we provide it “as is” and can't promise it will always be available or error-free. We may change or discontinue features. If a paid feature you rely on is removed, we'll give you notice.
  • To the extent the law allows, we're not responsible for indirect losses, or for content and conduct of other users.
  • This doesn't limit any liability that the law doesn't allow us to limit. If you're a consumer in Quebec, the Consumer Protection Act and the Civil Code of Québec fully protect you, and any clause here that conflicts with them doesn't apply to you.

10. App stores

If you use our iOS or Android app, these Terms are between you and Bantsy, not Apple or Google. Apple or Google are not responsible for the app or its support. Apple may enforce these Terms as a third-party beneficiary.

11. Changes to these Terms

If we change these Terms, we'll notify you at least 30 days in advance. The notice will show what's changing and when. If you don't agree, you can close your account and cancel your subscriptions before the change, at no cost.

12. Disputes

If something goes wrong, contact us first. We'd like to fix it.

These Terms are governed by the laws of Quebec and Canada. Disputes go to the courts of Quebec. If you're a consumer, you can also bring a claim where you live, and you keep the protections of your local law. We don't require arbitration, and we don't ask you to give up class actions.
